Town ordinances are passed by the Council and kept on file with the Town Clerk.  A summary of key ordinances that my be useful to all residents is listed below.

Subject

Ordinance No. and Summary Points

Animal Control

Ordinance 271 outlines the licensing procedure for pets, lists the kinds and number of animals permitted per property, and defines offenses and penalties.

Building Code

Ordinance 265 regulates the construction and maintenance of buildings, structures, and mechanical equipment within the Town, outlines which projects require permits, and sets forth the procedure for obtaining a permit to perform such construction or maintenance.  Ordinance 301 adds reference to Bellevue Fire Dept Development Standards.  Ordinance 324 amends the controlling uniform codes to those developed by the International Code Committee (per State Building Code statutes).  Ordinance 339 establishes a Heavy Truck Fee for projects with fair-market values in excess of $150,000.

Burglar Alarms

Ordinance 295 relates to electronic security devices and defines false alarms/penalties.

Comprehensive Plan

Ordinance 242 adopts the Town's Comprehensive Plan, a copy of which can be found by clicking here.  Ordinance 293 amends the Transportation element.   Ordinance No. 326 adopts the updated Comprehensive Plan for 2004.    Ordinance 331 and Ordinance 340 amend the adopting language of Ordinance 326 to meet state requirements.

Consolidated Permit Process

Ordinance 267 establishes a consolidated project-permit process in accordance with the Regulatory Reform Act.

Construction on WABA’s Beach Property

Ordinance  89, Ordinance 95, and Ordinance 100 establish the master program for any construction on WABA’s beach property, in accordance with the Shoreline Management Act.

Door-to-Door Solicitation

Ordinance 268, also known as the "Green River Ordinance", regulates the solicitation and sales of merchandise or services on private property within the Town  and declares that uninvited solicitors are a prohibited nuisance punishable as a civil infraction.  However, it clarifies that farmers, non-profit solicitors, sellers of newspapers, and persons acting on behalf of a school are exempt from this prohibition but limited to the hours between 10:00 am and 7:00 pm.


Fees
 

Resolution 243 sets forth fees for various services and permits within the Town of Beaux Arts Village.
 

Firearms and Fireworks

Ordinance 20 prohibits the discharge of firearms within Village limits.  Ordinance 211 prohibits the discharge of fireworks except by licensed professionals, and then only when authorized by the Council.

Flood Insurance, National Program

Ordinance 300 adopts guidelines from the national Flood Insurance Program to minimize public and private losses due to flood conditions in specific areas when identified.

Garbage, Recycled Materials, Yard Waste Collection

Ordinance 140 regulates the collection and removal of garbage.  Ordinance 223 prohibits the placement of yard waste in residential garbage or recycling containers.

House Trailer/ Camper Usage

Ordinance 349 prohibits the use of house trailers, campers, etc. as permanent living quarters for periods exceeding 14 days.

Lawn-Irrigation and Fire-Sprinkler Systems

Ordinance 332 requires that property owners arrange for the Town to inspect all lawn-irrigation systems for a backflow-prevention device after the system is installed.  No permit is needed to install a lawn-irrigation system, but a fee is charged for the inspection.  This ordinance also requires that backflow assemblies be tested annually for proper operation.  Property owners may arrange for testing through a contractor hired by the Town or on their own.  Test results must be submitted to the Town Clerk as soon as they become available.

No Wake Zone

Ordinance 294 establishes a No-Wake Zone along the Beaux Arts waterfront.  Ordinance 296 redefines "Wake".

Outdoor Burning

Ordinance 36 prohibits the burning of garbage anytime.  Ordinance 102 limits outdoor burning to the months of October, November, April and May and only after obtaining a fire permit at the Bellevue Fire Department or at Bellevue City Hall.

Parking

Ordinance 274 and Ordinance 333 regulate the parking of cars, RVs, boats, trailers, etc. and defines specific areas where parking is prohibited.  Passenger vehicles, boats, trailers, and RVs must be parked on private property -- not on the Town right of way.  In addition, boats, trailers and RVs must be screened from view.

Temporary guest vehicle parking is allowed on Town rights-of-way so long as the vehicle does not block through traffic and is not parked in a prohibited location.

Pools, Spas, & Hot Tubs

Ordinance 187 regulates the installation of swimming pools, hot tubs and other pools, establishes the need for a permit, and outlines plan and construction requirements such as fences, covers, etc.

Public Hearings

Ordinance 258 requires public hearings and provides for notice thereof.

Satellite Dish

Ordinance 349 governs the installation and maintenance of satellite receiving systems and establishes the need for a permit.

Subdivisions and Lot Consolidations

Ordinance 288 outlines the process for requesting a short subdivision or lot consolidation.

Traffic Control

Ordinance 273 specifies vehicle use and speed limits within the Village.


Tree-Cutting Moratorium
 

Ordinance 356 establishes a moratorium on tree cutting between April 15, 2008 and July 15, 2008.

Tree Removal

Ordinance 358 adopts requirements for the protection of trees on private property and established a process for their orderly and limited removal.
 

Vegetation Control

Ordinance 58 requires property owners to maintain shrubs, control weeds, etc., so as not to obstruct the use of streets or sidewalks and so not to be a fire or health hazard.

Water Department

Ordinance 357 establishes the rules and regulations of the Town Water Department.  Water usage is billed bi-monthly.  Payments must be postmarked by the 25th day of the month in which the bill is received and may be mailed to the

or deposited in the locked mail box on the stand opposite the water tower at the corner of SE 27th St. and SE 27 Pl.  Customers paying after the deadline will incur a late fee.

Wetland Protection

Ordinance 233 establishes a procedure for protecting wetlands consistent with the Growth Management Act.

Zoning and Land Use

Ordinance 349 regulates the location, use and size of buildings and structures, the use of land, commercial activities, density, and the sale, lease, division, etc. of land within the Town and outlines the process for requesting a variance to these regulations.  Some important features of the zoning code include:
> minimum 10,000-square-foot lots.
> single-family dwellings only.
> limited commercial activity requiring Council approval.
> setbacks for structures/appurtenances set at a minimum of 20 feet in the front, 25 feet in the rear, and 10 feet on each side; however, some landscape features are now allowed in the setbacks..
> lot coverage restricted to a maximum of 35% of the lot, including pools and all impervious surfaces.
> gross-floor-area restricted to a maximum of 35% of the lot, including garages and attached carports.
> building height restricted to a maximum of 30 feet.
> fence heights restricted to a maximum of six feet in most instances.
